Instagram model faces jail term for her false rape claim against Theo Hernandez

Luisa Kremleva, an Instagram model with dual Russian-Spanish nationality, is set to appear in court later this month over accusations of making a false rape claim against AC Milan defender Theo Hernandez.

Kremleva faces a possible two-year prison sentence if convicted, as public prosecutors have requested, alongside a fine of £12,000.

The case stems from an incident that allegedly took place outside the luxurious Olivia Valere nightclub in Marbella.

Kremleva initially told authorities that she had been raped in a Porsche Cayenne, claiming that Hernandez had assaulted her and caused knee injuries by pushing her out of the vehicle.

However, her allegations came under scrutiny after police reviewed CCTV footage that contradicted her account.

The footage reportedly showed Kremleva suffering her injuries in a fall outside the nightclub rather than as a result of an assault.

The legal proceedings took a turn when the court archived Kremleva’s rape claim due to lack of evidence.

Prosecutors intervened, indicating that they believe Kremleva acted "maliciously" in her accusations, particularly after Hernandez reportedly rebuffed her attempts to engage with him after what she claimed was consensual sex.

Hernandez, who has previously faced a rape allegation that was dismissed for lack of evidence, has maintained that any sexual encounter with Kremleva was consensual.

Despite the severity of the accusations against him, he was never arrested in relation to this case.

Following the claims, Kremleva’s mother appeared on Spanish television, insisting that her daughter was not under arrest and that “the truth will come out.”

Kremleva has publicly maintained her innocence regarding any wrongdoing, asserting on social media that she has not been arrested or convicted of any crime.

Her ongoing assertion that evidence of the alleged attack exists has raised questions about the motivations behind her initial claims.

The one-day trial is scheduled for October 28 at a court in Malaga, and while it remains unclear whether Hernandez will need to attend in person or can provide testimony via video link, both the public and media will be watching closely as the case unfolds.

The trial promises to shed light on serious issues surrounding false allegations and the impact they can have on the lives and careers of those involved.
